In DATA and SERVICES we inform you that the Treasury allows self-employed people and companies to disconnect from some obligations for 30 days thanks to the so-called tax holidays, during which they will not receive any type of notification from the Tax Agency.
What do they consist of?
Those who wish to take advantage of the tax holiday period can request the courtesy month each calendar year, with prior notice, and as long as they are registered with the Enabled Electronic Management System.
This rest period is useful because if we do not respond to the tax authorities' notifications, we would be exposed to a fine of between 150 and 600 euros, which could rise to 600,000 euros in very serious cases.
These holidays can be freely chosen by freelancers and companies, annually and in various periods. This is especially beneficial during the holidays, allowing you to disconnect without fear of penalties for not responding to tax requirements on time.
However, to benefit from these courtesy days, you must request them at least seven calendar days in advance of the start of the desired period and up to a maximum of thirty days, which can be divided if desired. You must also mark Saturdays and Sundays as courtesy days, as they are calendar days.
You should know that when the Treasury sends the notification, the deadline for responding opens. And after 10 days, the Tax Agency assumes that the notification has been received and begins the sanctioning period when relevant, if it has not received a response.
How to request tax holidays?
To request this courtesy period, you must enter your profile on the Tax Agency's electronic office and access the My notifications menu. Then, you can access all the available procedures and the option Request days on which notifications will not be sent to the enabled email address will appear in the list and you can fill out the request. The process is simple and requires identification via electronic certificate, permanent Cl@ve or Cl@ve PIN.
One of the benefits is that it helps improve the relationship between the administration and taxpayers, showing sensitivity towards the needs of rest and personal or business organization. It also avoids situations of legal helplessness, since it guarantees that the deadlines are adjusted to the periods in which people can exercise their rights normally.
