Company committee. Is it mandatory ?

Although having a works council is only mandatory for those organizations that employ a thousand or more people, the Workers' Statute recognizes works councils as a right for companies with more than 50 employees.

How is the works committee constituted?

Its members are chosen through elections in which all the company's workers can participate. However, they must be over 18 years old and have a seniority of one month to vote and six to be elected. In some agreements, due to staff mobility, it can be agreed that they are eligible only with three months of seniority

Regarding the number of members, it is determined based on the number of people who make up the staff.

Their mandate will last four years (the same as that of the staff delegates), being understood to be extended until new elections are called, once completed.

Who integrates it?

  • The president of the committee, who presides over the meetings, moderates the debates of the assemblies, ensures compliance with the rules of the works committee, signs the minutes of the meetings and takes the proposals to vote. He is also the legal representative before natural and legal persons and public administrations.
  • The secretary, who is responsible for supporting the president in his duties.
  • The rest of the members are made up of the members of the company who have presented themselves on the lists to join the committee and have been elected.

Powers of the works council

  • The main function of the works committee is to represent the workers collectively. Administrative, informative and collective bargaining functions are carried out in this internal body.
  • Take care that the rules applicable to workers and agreements with them are complied with. Being able to report or sue the company if this is not the case.
  • Monitor and control safety and health at work. Ensure equal treatment between men and women.
  • Participate in the management of social works by the workers, as established in the agreement.
  • Collaborate with the company to increase productivity.
  • Collaborate to establish measures to reconcile personal and work life.
  • Inform the workers of all these matters.
