Gender equality in the workplace is not only a matter of social responsibility, but also an evolving legal requirement. So, if your company developed an Equality Plan in 2021, now four years later, as established by the regulations, it is time to renew it.

What is an Equality Plan?

An Equality Plan is a set of measures aimed at achieving equal treatment and opportunities between women and men in companies, eliminating gender discrimination and the wage gap.

It is important to take into account the particularities of each company to justify, argue and take measures, so there is no single template or model. Carrying out a prior diagnosis is crucial to adapt it to the reality of each organization.

Although the Equality Plan was already mandatory for companies with more than 250 employees, in 2021 its establishment and registration was made mandatory for public and private companies with more than 150 employees. Finally, in March 2022, it was time for the last remaining section to adapt to the regulations, that is, companies with more than 50 employees.

How is the Plan renewed?

Changing the Equality Plan involves a structured process that must be followed meticulously to ensure the success of its implementation. But it is not only necessary to renew the Plan itself, but also to evaluate the measures that were implemented and the objectives that have been achieved. In this way, it can be updated and adapted to the new needs of the company in the negotiation process.

What happens if the company does not renew the Equality Plan?

Failure to comply with the obligation to renew or even not have an Equality Plan can lead to significant sanctions, from administrative to financial fines. Depending on the severity of the infraction and the size of the company, the fines vary and can be quite high. Ranging between 7,500 and 225,000 euros.

In addition to financial sanctions, companies may lose access to subsidies and public contracts, which poses a significant harm to their operations and growth.
