What changes will there be to the workday registration and time control?

This year there will be important developments in the labor field, particularly in the registration of working hours and time control. To begin with, the registration will have to be available in real time for labor inspection and this means that companies will no longer be able to submit late or incomplete registrations.

Let's review the main changes you need to know to be prepared.

What is employee time control?

  Time control is a system for the daily recording of the entry and exit times of employees during their work shifts and their correct storage.

Spain has been mandatory since May 2019, for all companies, regardless of size and sector, and for all workers. There are only a few exceptions.

Should breaks be recorded?

Yes, the time record must be as complete and detailed as possible. However, the Ministry of Labour and Social Economy's Guide to the Time Record explains that there is some margin for those breaks during the day, as well as other peculiarities depending on the type and modality of work.

What if you work remotely?

Time recording is also mandatory in teleworking. Time control software and any digital system make this control possible. In addition, they will serve to more accurately measure the productivity of employees who are not present in a workplace.

What do the current regulations say?

Since the registration of working hours is mandatory, as a measure to combat undeclared work and protect workers' rights, specific requirements are established:

  • Daily record of the working day. It is required to record the exact start and end time of the day, including breaks.
  • Record storage. Companies must retain this information for at least four years.
  • Guaranteed access. Records must be available to workers, unions and the labor inspectorate upon request.
  • The information collected must comply with the General Data Protection Regulation, GDPR.

Changes for this year

The draft law that will come into force this year proposes a complete transformation of the registration of the day. These are the most relevant new features:

  • The records of the working day must be available in real time for the labor inspection. This means that companies will no longer be able to submit late or incomplete records. The use of digital tools will be mandatory. Traditional methods such as spreadsheets or paper documents will no longer be accepted.
  • Any modification to the records must be documented, including justification and traceability. This ensures greater transparency and reduces the risk of manipulation.
  • Measures will be increased to ensure compliance with the GDPR, protecting employee privacy.
  • The penalties will be significantly higher. Minor violations can result in fines of up to 7,500 euros per worker.
