In what situations can unemployment be capitalized?

The capitalization of the unemployment benefit is aimed at different situations:

  • Join cooperatives or labor societies that have already been established, even if a previous contract has previously been maintained. Or create a new one.
  • Develop an activity as a freelancer, excluding in this case economically dependent freelance work, Trade.
  • Establish a company using the amount as the share capital of this new commercial entity. Or for a company created within a maximum period of 12 months prior to the contribution.

Requirements for the grant of unemployment capitalization

  • Have the right to the contributory unemployment benefit, therefore be in a legal situation of unemployment. In other words, to have terminated an employment relationship for a reason not attributable to the worker or to be entitled to unemployment benefits, which implies having contributed at least a period of 360 days for this contingency.
  • Not having made use of this right in the previous four years, nor having reconciled self-employment with having received unemployment benefit in the previous 24 months.
  • Start a business activity and submit the corresponding application with explanatory report and feasibility study.

Who can apply for unemployment benefits?

Those who meet the requirements indicated in the previous point and want to start an activity as a self-employed person, self-employed person of a commercial company, a cooperative company or a labor company.

It is not possible to apply if the registration is to be economically dependent self-employed or to contribute to the share capital of a company with which an employment relationship has previously been maintained.

How is the amount of unemployment to be capitalized calculated?

The calculation of the unemployment benefit to which you are entitled can be obtained through the SEPE.

You can request the amount necessary to invest, according to what is set out in the explanatory memorandum. If the necessary amount does not reach 100 percent of the benefit to which you are entitled, you can request that the rest be used to pay the social security contributions that will be generated as a result of the discharge self-employed, subsidy for the payment of social security benefits.
