BUILDING DAMAGE ASSESSMENT

"Law 38/1999, on Building Regulation, is the framework where the system of guarantees against damage to buildings is inscribed.The insurances provided to compensate the insured persons extend to periods of ten years in the case of damage that compromises the stability of the building, three years, in the case of defects or defects of finishes.These insurance does not include damage to adjacent buildings, personal, those caused to movable property and thus all the cases mentioned in the paragraph 9 of article 19 of the law.

The determination of the extent of the damage, from small defects to large claims, is subject to expert action. The procedural activity to carry out the expert deposition is regulated in the Civil Procedure Law. However, at the present time there are not enough technical guidelines so that adequate judgments can be brought to the judiciary in order to be able to evaluate the report and expert evidence efficiently in the light of compliance with the requirements expressed in current regulations, with the purpose of adapting such action. To this end, we have the participation of prominent professionals of the activity together with the contribution of the insurance sector. "
